WHERE INFORMATION IS MAINTAINED AND USED
The Services are intended solely for users within the United States. Individuals outside of the United States should not use the Services or provide any data to Friendly’s. By using the Services or providing us with data, you acknowledge and agree that your personal information may be transferred to, processed and/or maintained outside of your state, province or country, and where laws regarding processing of personal information may be less stringent than the laws in your location. By providing your data or using the Services, you acknowledge such transfer, processing and maintenance.
THE TYPES OF INFORMATION WE COLLECT
Friendly’s collects information from you in various ways when you access or use the Services. We collect personal information from you in the following ways:

We and/or our Analytics Companies may collect the geographic location (which may include longitude and latitude) of your mobile device based upon information identified by your mobile device by, for example, using satellite, cell phone tower, WiFi signals, beacons, Bluetooth and near field communication protocols. We may use and share your mobile device’s geographic location together with personal and other information to identify your local Friendly’s restaurant, to provide you with personalized messaging or content and/or for marketing purposes by email, push notification, online or in-app advertising, or by other means. If you choose to opt-out of location collection, certain functionality of our Services may not be available.
HOW WE USE YOUR INFORMATION
We use the information we collect from all of our Services for a number of purposes, including to provide, maintain, protect and improve them, to develop new ones, and to protect Friendly’s and our users.
(a) General Use.
In general, we use your personal information to respond to your requests as submitted through the Services, to provide you products and services you request, or to aid us in serving you better.
We use your personal information to do the following:
If any of our Services require creation of a profile (“Profile”), we may use the name you provide for your Profile across more than one of our Services that require a Friendly’s Account. In addition, we may replace past names associated with your Profile so that you are represented consistently across all our Services.
We may combine personal information from one Service with information, including personal information, from other Services or from Affiliates.
(b) Targeted Marketing.
We and our Analytics Companies may implement and evaluate our marketing activities and the Friendly’s Rewards Programs, including to engage in targeted and personalized online advertising on the Services, in third-party website, application, television, or other online or offline services operated by third parties. This marketing may be targeted to you based on personal or other information collected over time, such as through your participation in the Friendly’s Rewards Programs, your activity on the Services, your device’s geographic location (which may include longitude and latitude), your activity on unaffiliated third-party websites, applications, or other online services, other marketing activities and programs, and/or from third parties with whom we work. We and our Analytics Companies may use tracking technologies to collect information for such marketing and evaluation purposes. We and our Analytics Companies may also identify whether our marketing activities and Friendly’s Rewards Programs resulted in you engaging in other activities on our Services, our advertising and/or marketing, making purchases from us and/or our franchisees, visiting family friendly restaurants, or otherwise engaging with us. In addition, we and our Analytics Companies may target Friendly’s ads to you on your television or other online services if we or our Analytics Companies have identified you as a Friendly’s customer using information we share with them, such as your name, email address, or mailing address.
(c) Cross-Device Technologies.
We and our Analytics Companies may use collected information to establish connections among related web browsers and devices (such as smartphones, tablets, computers, and televisions) for targeted advertising, analytics, attribution, and reporting purposes. We and/or our Analytics Companies may match your browsers or devices if you log into the same online service on multiple devices or if your devices share similar attributes that support an inference that they are used by the same person or household. This means that your online behavior (i.e., information about your activity on websites or applications on your current browser or device and your device’s geographic location, which may include specific longitude and latitude) may be combined with information collected from your other browsers or devices. For example, our Analytics Companies may use this information to deliver an ad on your tablet or smartphone, to limit the number of times you see an ad across your devices, and to help measure the effectiveness of advertising campaigns across devices.
(d) Opt-Out Choices.
You may opt out of certain of our or our Analytics Companies’ targeted marketing practices in web browsers and Applications by following the instructions below. Please note that the opt out will apply onto the specific browser or devices from which you opt out. You will need to opt out separately on all of your browsers and devices. If you delete or reset your cookies or mobile identifiers, change browsers, or use a different device, any opt-out cookie or tool may no longer work, and you will have to opt out, again. Note that some service providers may also make their own opt-out processes available. Please note that even if you choose to opt out of receiving targeted advertising, you may still receive advertising about Friendly’s, but it will not be tailored to your interests.
If you would like to request that Friendly’s limit the use or sharing of your personal information or other targeted marketing purposes, such as deliver targeted ads to you on your television (where available), or other online service based on your personal information, please contact us at AllFieldHelpdesk@ficrg.com. If your personal information has previously been shared with other service providers or other third parties, any request to limit such sharing may not be effective with respect to such previously shared personal information. Some of the Analytics Companies that display our ads on their services may provide you with additional choices to opt out of targeted advertising. Please review the privacy policies of the third-party services you use for more information.
(e) Creation of Anonymous Data.
DISCLOSURE OF YOUR PERSONAL DATA.
(a) Ordering and Purchasing.
When you order menu items on a Service, we will transmit your order to the location designated by you, so that we can fulfill your order. We may also share your personal information with Affiliates or third-party providers so that they can directly market their products and services to you.

PLEASE NOTE THAT WE ARE ONLY REQUIRED TO RESPOND TO ONE REQUEST PER CALIFORNIA CUSTOMER EACH YEAR.
(b) Third-Party Service Providers.
We may share your personal information with third-party service providers to: (i) provide you with the Services that we offer you through our Services; (ii) to conduct quality assurance testing; (iii) to facilitate the creation of accounts; (iv) to process payments; to provide technical support; and/or (v) to provide other services to you.

Enrolling in our Friendly’s BFF Club or any other Rewards Program is completely voluntary. When you enroll in a Rewards Program, Friendly’s will collect personal information about you that may include your name, mailing address, email address, phone number and/or other information. We store this information so that we can administer the program properly, process your rewards, and communicate offers to you based on your interests. From time to time, we may ask you to supply other information about your household’s consumer interests. Certain information may be required in order to participate in a Rewards Program and other information may be voluntary. If you do not wish to provide any mandatory information, you may choose not to participate in any Rewards Program.
A NOTE ABOUT CHILDREN
We do not intentionally gather personal information about Site visitors or Application users who are under the age of 13. Furthermore, we do not intentionally allow Site or Application users under the age of 18. If you are under the age of 18, please do not provide us any personal information or use the Services without receiving your parent’s or guardian’s permission. If a child under 13 submits personal information to Friendly’s and we learn that the personal information is the information of a child under 13, we will attempt to delete the information as soon as possible. YOUR CHOICES REGARDING YOUR INFORMATION.
You have several choices regarding use of information on our Services.
If you decide at any time that you no longer wish to accept cookies from our Site for any of the purposes described above, then you can instruct your browser, by changing its settings, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. Consult your browser’s technical information. If you do not accept cookies, however, you may not be able to use all portions of the Site or all functionality of the Services.
(b) De-Linking SNS.
If you decide at any time that you no longer wish to have your SNS account (e.g., Facebook or Twitter) linked to your Account, then you may close your Account with Friendly’s. Please refer to the privacy settings of the SNS to determine how you may adjust our permissions and manage the interactivity between the Services and your social media account or mobile device.
You can stop all collection of information by the Application by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the Application marketplace or network.
(d) How We Respond to Do Not Track Signals.
Some web browsers transmit “do not track” signals to the websites and other online services with which your web browser communications. There is currently no standard that governs what, if anything, websites should do when they receive these signals. We currently do not take action in response to these signals. If and when a standard is established, we may revise our policy on responding to these signals.
We work hard to protect Friendly’s and our users from unauthorized access to or unauthorized alteration, disclosure or destruction of information we hold. In particular:
